The privacy, confidentiality, and security of your information is very important to White Cap Supply Holdings, LLC and its subsidiaries, divisions, and affiliates ("White Cap”).  We have prepared this Privacy Notice to let you know about the manner in which we collect, use, disclose, and otherwise manage the personal information we may collect about you at any of our warehouses or store locations (the "Stores"), and through any White Cap Call Centers (the "Call Centers"), in-person events (“Events”), websites and mobile applications (the "Sites"), our approved marketing partners ("Marketing Partners"), our authorized service providers ("Service Providers"), or any other circumstance in which you are provided with a copy of this Privacy Notice.  White Cap may update its privacy notice periodically to reflect changes in our business practices, technologies, legal requirements, or other operational needs.  If we make material changes to this Privacy Notice, we will update the Effective Date and provide notice in a manner reasonably designed to inform consumers of the changes, such as by posting a prominent notice on our website, through any applicable user account, by email where available, or by other means required or permitted by applicable law. We may update this Privacy Notice periodically to reflect changes in our business practices, technologies, legal requirements, or other operational needs. If we make material changes to this Privacy Notice, we will update the Effective Date and provide notice in a manner reasonably designed to inform consumers of the changes, such as by posting a prominent notice on our website, through any applicable user account, by email where available, or by other means required or permitted by applicable law.

Information We Collect

We may collect your information when you:

  • Visit our Stores;
  • Purchase, order, rent, return, exchange, or request certain information about our products and/or services;
  • Apply for a line of credit with our business;
  • Contact a Call Center, sales associate, or customer service desk, or interact with us via email or other forms of communication;
  • Interact with us at an Event;
  • Visit or register with our Sites; or
  • Provide us with feedback, comments, or suggestions.

Information You Provide to Us

We may collect information from you directly, including at our Stores, at Events, through our Call Centers, or on our Sites.  This information may include your name, address and billing information, email address, telephone and facsimile numbers, social security number and other government identification, financial and insurance information, geolocation data, IP address and other information related to your business and your account with White Cap, and any other information you provide in the course of interacting with us, including information provided using our online Help Center web forms such as the Request a Quote web form.

Information We Collect through Automated Data Collection Technologies

We may collect your information using automated data collection technologies as described in the “Additional Information about our Sites” section below.  Additionally, when you visit our Stores or other physical locations, we may collect video and audio recordings of your activity in our Stores through our use of CCTV and other recording equipment.

Information We Obtain from Third Parties

We may obtain your information through third party sources such as lead generation companies, credit bureaus, social networks, data brokers, internet service providers, data analytics providers, advertising networks, Marketing Partners, affiliates, and Service Providers.

How We Use Your Information

We use your information:

  • To fulfill or meet the reason you provided the information, such as fulfilling orders, deliveries, and returns, processing credit applications, facilitating loyalty and rebate programs, and responding to inquiries.
  • To facilitate and improve the operation of our business, including to maintain the safety, security, and integrity of our Sites, products, and services.
  • To issue and monitor equipment rentals and similar services.
  • To help us gain a better understanding of your preferences and interests so we can improve our products, services, and marketing to better serve you, your business, and/or our other customers.
  • To inform you or your business about products and services, sales, and special offers that might benefit you or your business.
  • To respond to your feedback, suggestions, survey information, and comments to monitor and/or improve the ways in which we serve you.
  • To register you for Events and other meetings you sign up for.
  • For internal legal compliance purposes.
  • To provide the information to Service Providers and other third parties as described in the “Sharing Your Information” section below.
  • For other purposes consistent with the context of the collection of your information or as otherwise disclosed to you prior to the use of your information.

Call Centers

When you call one of our Call Centers about a product, delivery, installation, billing question, or customer service, you may be asked for information that identifies your business along with additional information we need to help us promptly answer your question, such as your name and address or a telephone number where we might contact you or another person in your business.  We may retain this information to assist your business in the future.

Online Registration

Registration is an optional service provided by some of our Sites.  You do not have to register your business to browse online.  When you register, you may be asked for information such as your name, business name, address, telephone number, email address, password, and business interests.  This registration information may be used to help make your online shopping quicker and easier by, for example, pre-populating certain parts of your information.

Email Marketing

When you register online or participate in a survey, you will have the opportunity to sign up for emails about our products, services, sales, and special offers.  You may unsubscribe from our email marketing by clicking the “unsubscribe” link in these emails.

Data Retention

We retain your information as long as reasonably necessary for the uses described in this section.  In determining the criteria by which to retain or dispose of your information, we consider the type, sensitivity, context, and purpose of collecting the information.

Sharing Your Information

In the course of our business, we may disclose your information to third parties in the following circumstances.

Service Providers and Companies That Work with or on Behalf of White Cap

We share your information with Service Providers for operations, technology, payment, and marketing.  Some of our operations, such as our Call Centers, may be managed by unaffiliated partner companies.  In addition, if you purchase special products or services from White Cap, these products or services may not be provided by White Cap affiliates, but rather by reputable local or national companies with which we contract to provide such services.  Other third parties provide technology we use on our Sites to optimize your shopping experience and to market relevant products and services to you on our Sites and in email communications that you agree to receive. As explained below in Additional Information about our Sites, we also share your information with third parties for digital advertising purposes.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

Sale of Business

White Cap may transfer any information we have about you in the event we sell or transfer all or a portion of our business or assets to a third party as part of a merger, acquisition, bankruptcy proceeding, or other restructuring or similar transaction.

Legal Purposes

We may provide your information if we have a good faith belief that the law requires it, such as in response to a search warrant, subpoena, or other legally valid inquiry, order, or process, or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required by law.  We may also disclose information to assist us in collecting a debt, or as necessary to exercise our legal rights or defend claims brought against us.

Additional Information about our Sites

Visiting our Sites

In general, you can visit our Sites without telling us who you are or providing us with your business information.  However, we collect the IP (internet protocol) addresses of all visitors to our Sites and other related information such as page requests, browser type, operating system, and average time spent on our Sites.  We use this information to monitor and improve our Sites and to serve ads that may be of interest to you.

Interest-Based Advertising

Our Sites may collect information about your online activities for use in providing you with advertising about products and services tailored to your individual interests. You may see certain ads on other websites because we participate in advertising networks. Ad networks allow us to target our messaging to users through demographic, interest-based and contextual means. These networks track your online activities over time by collecting information through automated means, including through the use of cookies and other online technologies. The networks use this information to show you advertisements that may be tailored to your individual interests. The information our ad networks may collect includes information about your visits to websites that participate in the relevant advertising networks, such as the pages or advertisements you view and the actions you take on the websites. This data collection takes place both on our websites and on third-party websites that participate in the ad networks. This process also helps us track the effectiveness of our marketing efforts.

Cookies

Our Sites use cookies to improve the overall function and efficiency of our Sites.  A cookie is a tiny element of data that our Sites and our third-party technology providers can send to your browser, which may then be stored on your hard drive so we can recognize you when you return.  All pages on our Sites where you are prompted to log in or that are customizable require that you accept cookies.  If you have registered with our Sites, these cookies (1) may let us know who you are, (2) may be necessary to access your account information (stored on our computers) in order to deliver products and personalized services, and (3) will provide us and our Service Providers with information that we will use to personalize our Sites in accordance with your preferences.  Cookies also help optimize your shopping experience in that they allow you to add multiple items to your shopping basket before checking out and help us to recommend relevant products to you. We also use cookies to collect information about you for advertising purposes.

You may be able to control what cookies your web browser accepts through your browser settings.  However, please note that some aspects of our Sites may not function properly should you decide not to accept cookies from our Sites, which could impact your experience on our Sites.

Web Beacons

Our Sites and marketing emails may also use a technology called "web beacons”.  These may also be referred to as "tags", "Clear GIFs", or "tracking pixels”.  Web beacons are tiny, unobtrusive graphics embedded on a web page that signal a user has accessed content.  This technology allows us and our third-party technology providers to understand which pages you visit on our Sites.  These web beacons are also used to help us optimize and tailor our Sites for you and other future visitors to our Sites.

Third Party Links

Our Sites may include links to our business partners' websites, vendors, and advertisers.  White Cap provides links to third-party websites as a convenience to the user.  The inclusion of any link does not imply White Cap's endorsement of any other company, its websites, or its products and/or services.  These linked websites are not subject to this Privacy Notice and may have separate and independent terms of use and privacy policies, which we recommend you read carefully.  We have no control over such websites and therefore have no responsibility or liability for the manner in which the organizations that operate such linked websites may collect, use, disclose, or otherwise treat your information.

 Google Analytics

We use automated technologies and applications, such as Google Analytics, to evaluate usage of our Sites.  We also may use other analytic means to evaluate our Sites and services.  We use these tools to help us improve the Sites, performance, and user experiences.  These entities may use cookies and other tracking technologies to perform their services.  To learn how Google Analytics collects and processes data, please visit: https://policies.google.com/technologies/partner-sites.

How We Respond to Do Not Track (DNT) Settings

 Some web browsers (including Safari, Internet Explorer, Firefox, and Chrome) incorporate a "Do Not Track" ("DNT") or similar feature.  At the present time, the Sites do not respond to DNT signals.

Global Privacy Control

We process opt-out preference signals from Global Privacy Control (“GPC”). GPC is a browser-level technical specification that you can use to inform websites that you opt-out of sales, sharing of data for cross-context behavioral advertising, or targeted advertising. If you use GPC, our website will treat the browser and device you use to access our website as opted-out from sales, sharing or targeted advertising to the extent we engage in such processing. If you are not logged into your account when you use GPC, your opt-out request will be limited to the browser or device you use to access our website. Security of Your Information

We maintain administrative, technical, and physical safeguards designed to protect against unauthorized access, use, modification, and disclosure of your information in our custody and control.  No data, on the internet or otherwise, can be guaranteed to be 100% secure.  While we strive to protect your information from unauthorized access, use, or disclosure, White Cap cannot and does not ensure or warrant the security of your information.

Children’s Privacy

 White Cap does not knowingly collect personal information from children under the age of 16.

Your State Privacy Rights

This section applies to you if you reside in a U.S. state that has enacted a comprehensive consumer data privacy law, such as the California Consumer Privacy Act, subject to any applicable exemptions.

“Personal Information” We Collect

The categories of personal information that we may collect include:

  • Identifiers, such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, or other similar identifiers.
  • Geolocation data.
  • Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), such as name, address, telephone number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information.
  • Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website application, or advertisement.
  • Audio, electronic, and visual information.
  • Professional or employment-related information.
  • Inferences drawn from other personal information identified in this section to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, and attitudes.
  • Sensitive personal information, such as, account log-in, financial account, debit card, or credit card number in combination with the required security or access code, password, or credentials allowing access to the account, and geolocation. Please note we do not collect sensitive personal information for the purpose of inferring characteristics about you.

In the “Information We Collect,” “How We Use Your Information,” and “Sharing Your Information” sections of this Privacy Notice, we explain the sources from which we collect personal information, the purposes for collecting personal information (i.e., how we use your information), the parties to whom we disclose your personal information, and our retention policy.

Additionally, the Company may collect, use or sell personal information for the purpose of training large language models only to the extent our service providers use such models to provide services to us.

Disclosure of Personal Information

We disclose all or substantially all categories of personal information that we collect to our service providers for the purposes detailed in the “How We Use Your Information” section of this Privacy Notice. We do not disclose sensitive personal information for any purpose other than that described in this Privacy Notice.

We disclose all or substantially all categories of personal information that we collect to advertising networks and social networks to serve ads on our Sites or third-party sites. This may be considered “selling” or “sharing” personal information or “targeted advertising” as these terms are defined in the California Consumer Privacy Act (CCPA) or other U.S. state laws.

We do not knowingly sell or share the personal information of individuals under sixteen years of age.

Your Privacy Rights

 You may have the following rights with respect to your personal information under applicable state law:

(i) Right to Know About Personal Information Collected, Disclosed, or Sold

You may have the right to request that we provide certain information to you about our collection and use of your personal information.  Specifically, you may have the right to request disclosure of:

  • The specific pieces of personal information we collected about you;
  • The categories of personal information we collected about you;
  • The categories of sources from which personal information was collected;
  • Our business or commercial purpose for collecting, selling or sharing personal information; and
  • The categories of third parties to whom we disclose your personal information or personal information generally.
  • The categories of third parties to whom we sell your personal information or personal information generally.

(ii) Right to Request Deletion of Personal Information

You may also have the right to request that we delete any of your personal information that we collect or maintain about you, subject to certain exceptions.

(iii) Right to Correct Inaccurate Personal Information

You may also have the right to request that we correct inaccurate personal information we maintain.

(iv) The Right to Opt-Out of the Processing of Personal Data for Targeted Advertising, Sale or Sharing, or Profiling in Furtherance of Automated Decisions that Produce Legal or Similarly Significant Effects Concerning the Consumer

You may also have the right to request that we not sell or share your personal information or use it for targeted advertising or for profiling in furtherance of automated decisions that produce legal or similarly significant effects, as those terms are defined under applicable privacy laws.

We do not use your personal information for profiling in furtherance of automated decisions that produce legal or similarly significant effects.

(v) The Right to Limit the Use and Disclosure of Sensitive Personal Information

We do not process sensitive personal information in a manner that requires us to support the right to limit the use or disclosure of such information.

(vi) Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights

We will not unlawfully discriminate against you for exercising any of your applicable privacy rights.

(vii) Exercising Your Privacy Rights

To request to exercise your rights described above, please submit a verifiable consumer request to us by using the information in the “Contact Us” section below. Only you or your “authorized agent,” as defined in applicable law, may make a consumer request related to your personal information.

Under applicable law, you may designate an authorized agent to make a request on your behalf. You may make such a designation by providing the agent with written permission to act on your behalf. We will require the agent to provide proof of that written permission. To the extent permitted by law, we may require you to verify your own identity in response to a request, even if you choose to use an agent.

To the extent permitted by law, your verifiable consumer request must: (i) provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.  We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  We will use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.  Making a verifiable consumer request does not require you to create an account with us.

If your rights request is denied, you may lodge an appeal with us. The response to your rights request will inform you of any appeal rights you may have and how you may exercise them.

(vi) Your Rights Under “Shine the Light”

In addition to your rights under the CCPA, California Civil Code Section 1798.83 permits California residents who are established customers to request information regarding our disclosure, if any, of their personal information to third parties for their direct marketing purposes.  If this applies, you may obtain the categories of personal information shared and the names and addresses of all third parties that received personal information for their direct marketing purposes during the immediately prior calendar year.  You may submit this request using the information in the “Contact Us” section below.
